Terms of Service

These terms govern your use of MyUpMonitor ("the Service"). By creating an account, you agree to these terms.

The Service

MyUpMonitor is an uptime monitoring service. We periodically check URLs you provide and notify you when they become unavailable. We also provide status pages, incident tracking, and related tools.

Your Account

  • You must provide a valid email address to create an account
  • You are responsible for keeping your password and API keys secure
  • You are responsible for all activity under your account
  • You must be at least 16 years old to use the Service
  • One person or organization may not maintain more than one free trial

Acceptable Use

You agree not to use the Service to:

  • Monitor URLs you do not own or have permission to monitor
  • Perform denial-of-service attacks or load testing via our check system
  • Set check intervals below your plan's minimum to generate excessive traffic
  • Monitor URLs hosting illegal content
  • Circumvent rate limits or plan restrictions
  • Resell access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms.

Free Trial

New accounts receive a 14-day free trial with access to Pro-level features. No credit card is required. When the trial ends, you must subscribe to a paid plan to continue. Monitors are paused (not deleted) if the trial expires without a subscription.

Payment

  • Paid plans are billed monthly via Stripe
  • Prices are listed on our pricing page and may change with 30 days notice
  • Subscriptions auto-renew unless you cancel before the billing date
  • You can cancel anytime from billing settings or the Stripe customer portal
  • We do not offer refunds for partial months, but you retain access until the end of your billing period
  • Applicable taxes are calculated and collected by Stripe based on your location

Service Availability

We aim to keep MyUpMonitor available at all times, but we do not guarantee 100% uptime:

  • The Service is provided on a best-effort basis
  • We may perform maintenance that temporarily affects monitoring checks
  • We are not liable for delayed or missed notifications
  • Enterprise customers may negotiate a separate SLA

Data and Ownership

  • You own your monitoring data (URLs, check results, incidents)
  • We may use aggregate, anonymized data for service improvement
  • You can export your data via the API at any time
  • When you delete your account, all your data is permanently removed

Limitation of Liability

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for damages resulting from downtime, missed alerts, or service interruptions
  • Our total liability is limited to the amount you paid us in the 12 months before the claim

Termination

  • You can delete your account at any time from Settings
  • We may terminate accounts for violation of these terms, with notice when possible
  • Upon termination, your data is deleted per our Privacy Policy

Changes to These Terms

We may update these terms. We will notify you of significant changes via email at least 30 days in advance.

Governing Law

These terms are governed by the laws of Portugal. Disputes will be resolved in the courts of Lisbon, Portugal.
